When to Get Help
Violating Status
You should seek immigration help from International Student Services as soon as you realize that you may have violated your F or J immigration status or are facing challenges that could impact your ability to remain in the U.S. This includes situations such as falling out of status due to failure to enroll full-time, unauthorized employment, expiration of your I-20 or DS-2019, or termination of your SEVIS record.
As Designated School Officials and Alternate Responsible Officers, ISS staff are required to report status violations to SEVP. If this happens, we are here to help you resolve the issue and guide you through the regaining status process. When you meet with an ISS advisor about status violations, we may encourage you to also seek the help of an immigration attorney.
Applications with U.S. Government
You should also seek assistance at certain times when there are complex decisions related to your immigration status.
- ISS strongly advises any student going through the Change of Status process to discuss the timeline and implications.
- We also recommend you meet with an immigration attorney when deciding to close your F or J immigration status while in the U.S. while an application for another status is pending with USCIS.
- Lastly, if you have a pending application with the government and receive a request for information or a denial, working with an attorney can help you respond to these decisions.
Note: ISS can only advise on applications that relate to or affect your F or J status. In other situations, we recommend you speak with an immigration attorney.
Difficulties Entering or While in the U.S.
If you are unsure about their rights, are approached by immigration authorities, or face difficulties re-entering the U.S., legal guidance can be helpful. Consulting International Student Services as well as an immigration attorney or a qualified legal aid organization can help you understand your options, avoid serious consequences, and take the right steps to protect your status.
Finding Legal Help
Finding the right immigration attorney is important for international students facing status violations or other immigration challenges. When searching for legal assistance, you should start by checking reputable sources such as the American Immigration Lawyers Association (AILA) directory, university resources, or nonprofit organizations specializing in immigration law. It’s important to verify that the attorney is licensed and experienced in handling F and J visa cases.
Ways to Find Lawyers
- You might be able to start with Student Legal Services (SLS) in the HUB, as they have an immigration specialist on staff. Please first review the SLS eligibility criteria to ensure you can use their services. The SLS attorney may be able to provide some initial information and refer you to local immigration law firms, if needed.
- Check the American Immigration Lawyers Association (AILA) website, click Immigration Lawyer Referral Service.
- Call your local bar association lawyer referral service. In King County, contact the King County Bar Association at 206-267-7100.
How Should I Make My Decision to Hire a Lawyer?
Consider the following factors before agreeing to hire a lawyer:
- Can you communicate effectively with the lawyer? Was the lawyer clear and easy to understand?
- Are the fees comparable in comparison with other lawyers’ charges?
- Did the lawyer give clear explanations of how he or she will let you know about progress in your case?
- If you are not satisfied with this lawyer, do not hire them. Look elsewhere for legal help.
Before you finally sign a contract with a lawyer, read it carefully. Make sure you understand it. Everything you and the lawyer agreed to should be in writing. If you have a problem with your lawyer, you should discuss it with them or contact the Washington State Bar at 1-800-945-9722.
